As criteria are met, the non-custodial parent is automatically submitted for every enforcement remedy available to us to collect the past due support. No action is needed from the custodial parent for enforcement to begin. These include the State and Federal Refund Offset Program, Financial Institution Data Matches (bank liens), running tape matches with the Credit Bureau, Department of Employment Security, Internal Revenue Service, Secretary of State, Social Security Administration, suspension of Illinois professional licenses and Illinois driver's license, passport denial, and placing liens on real and personal property.
Until monies are received from our collection remedies, we cannot tell you if/when those monies will be collected through our enforcement tools. Child Support Services has no way of knowing if a non-custodial parent files an income tax return or if he/she is eligible to receive a refund until the monies are sent to us by the Internal Revenue Service (IRS). This is not an issue that the Department can address.
Driver's license suspension, suspension of hunting and fishing licenses or other consequences for non-payment of support are based on specific criteria and non-receipt of payments. If the non-custodial parent meets the driver's license suspension criteria, he/she will automatically be submitted.
Please understand that strict confidentiality policies will not allow Child Support Services to disclose the specific criteria for each enforcement remedy available. We are also not authorized to disclose which enforcements are currently being pursued, or which enforcements are currently in place.
