Only the court that issued the order has the legal authority to demand an immediate "lump sum" payment from the non-custodial parent. If you wish to pursue a single "lump sum" payment for the full balance owed to you, you must pursue that issue in the court that issued the order. Payments received since 8/4/25 have been voluntary payments received directly from the non-custodial parent.

Until monies are received from our collection remedies, we cannot tell you if/when those monies will be collected through our enforcement tools. Child Support Services has no way of knowing if a non-custodial parent files an income tax return or if he/she is eligible to receive a refund until the monies are sent to us by the Internal Revenue Service (IRS). This is not an issue that the Department can address.

 

The SDU is not responsible for enforcing Child Support Orders. It cannot "favor" non-custodial mothers because it was created by federal mandate to the sole purpose of being a disbursement center for all court ordered child support payments within the state of Illinois. The SDU receives the child support payments, posts them to the correct court order (docket) and mails or electronically transfers the payment to the custodial parent. 

 

Child Support Services is responsible for enforcing payments and balances for Child Support Orders. You have been provided with our enforcement actions many times in the past and also advised that those actions are taken automatically by our computer system as the non-custodial parent meets criteria for enforcement. This means that there is no "human hand" in those enforcement actions.

These include the State and Federal Refund Offset Program, Financial Institution Data Matches, running tape matches with the Credit Bureau, Department of Employment Security, Internal Revenue Service, Secretary of State, Social Security Administration, suspension of Illinois professional licenses and driver's license, passport denial, and placing liens on real and personal property.

Please understand that strict confidentiality policies will not allow our Department to disclose the specific criteria for each enforcement remedy available. Nor is the Department authorized to disclose which enforcements are currently being pursued, or which enforcements are currently in place.

He gets $60.00 per week. That comes out to $240. per month. she still owes him $216.67 per month which she isn't paying.  

Do the math. She still owes him. The principal debt is being barely resolved.

The tax intercept should take care of some of her obligation to  him.

All I can do is point out the facts. I wouldn't have to if I didn't have to live in a world where the state disbursement unit wasn't skewed towards non-custodial mothers. 

She still accrues $216.67 that is added to her debt.

She only pays $43.33 per month towards the amount that  she owes him.

 20% of the ordered terms is the additional amount to be withheld from wages until the delinquency balance is satisfied. 

 Delinquency is an additional amount the non-custodial parent

 is ordered to PAY each month until the delinquent balance is

 paid off. It is not an amount that is to be CHARGED as an 

additional penalty fee added to the balance.

These include the State and Federal Refund Offset Program, Financial Institution Data Matches, running tape matches with the Credit Bureau, Department of Employment Security, Internal Revenue Service, Secretary of State, Social Security Administration, suspension of Illinois professional licenses and driver's license, passport denial, placing liens on real and personal property; and reporting the debt to credit reporting agencies.

Please understand, strict confidentiality policies will not allow our department to disclose the specific criteria for each enforcement remedy available nor is the department authorized to disclose which enforcements are currently being pursued, or which enforcements are currently in place.
